The legal representative for the Electoral Commission (IEC), Advocate Terry Motau has argued in the Constitutional Court that the IEC’s online nomination system warned users that failure to press the final submission button meant a nomination had not been submitted.

Motau told the Constitutional Court that the system generated reminders advising users to press the “Submit as Final” button before the nomination deadline.

He said the requirement was communicated through training sessions, user manuals, demonstrations and automated notifications.

Motau was arguing in a matter between the African National Congress (ANC) and the IEC, in which the ANC challenged the IEC’s decision to exclude its candidate lists in six municipalities ahead of the 4 November Local Government Elections.

“The system continuously prompts the users and advising them of the need to comply with this obligation.”
